Privacy Policy

1.1 Data Controller. NovaStackCollective, located at Avenida Amália Rodrigues 1110, Tires, 2785-632 São Domingos de Rana, Portugal, is the data controller responsible for the processing of personal data collected through this website.

1.2 Data We Collect. We may collect and process the following categories of personal data: name, email address, phone number, project description, IP address, browser type, operating system, pages visited, referring URLs, and cookie identifiers.

1.3 Purpose of Processing. Personal data is collected and processed for the following purposes: responding to inquiries and project requests, providing web development and related services, sending service-related communications, improving website functionality and user experience, and complying with legal obligations.

1.4 Legal Basis. Processing is carried out under Article 6(1)(b) of the GDPR (performance of a contract), Article 6(1)(f) (legitimate interests in service provision and security), and Article 6(1)(a) (consent for non-essential cookies).

1.5 Data Retention. Personal data is retained for as long as necessary to fulfill the purposes for which it was collected. Inquiry data is retained for 24 months from the date of submission. Contract-related data is retained for the duration of the contractual relationship plus 6 years in accordance with Portuguese commercial law.

1.6 Data Sharing. We do not sell personal data. Data may be shared with: hosting providers (for website operation), payment processors (for transaction completion), email service providers (for communication), and analytics platforms (for website improvement). All third-party processors are bound by data processing agreements in compliance with Article 28 GDPR.

1.7 International Transfers. Where data is transferred outside the European Economic Area, we ensure adequate safeguards through Standard Contractual Clauses (SCCs) approved by the European Commission.

1.8 Your Rights. Under the GDPR, you have the right to: access your personal data (Art. 15), rectification of inaccurate data (Art. 16), erasure of data (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), and object to processing (Art. 21). 1.9 Right to Complain. You have the right to lodge a complaint with the Portuguese supervisory authority: Comissão Nacional de Proteção de Dados (CNPD), located at Av. D. Carlos I, 134-1.°, 1200-651 Lisbon, Portugal.

Terms of Service

2.1 Acceptance. By accessing or using the services provided by NovaStackCollective, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

2.2 Scope of Services. NovaStackCollective provides web development, database architecture, responsive layout engineering, security auditing, cloud deployment, API design, performance optimization, e-commerce system development, SEO auditing, and maintenance services as described on our website.

2.3 Project Proposals. All projects begin with a written proposal or blueprint outlining scope, deliverables, timeline, and pricing. Proposals are valid for 30 days from the date of issue.

2.4 Payment Terms. Unless otherwise specified in the project proposal: 50% deposit is required before work commences; remaining 50% is due upon project completion and delivery; all invoices are payable within 14 days of issuance; late payments incur a 2% monthly interest rate in accordance with Portuguese law.

2.5 Intellectual Property. Upon full payment, NovaStackCollective assigns all intellectual property rights in the delivered work to the client. NovaStackCollective retains the right to display the work in portfolio and case studies unless the client objects in writing.

2.6 Confidentiality. Both parties agree to maintain confidentiality of proprietary information exchanged during the project. This obligation survives the termination of the agreement for a period of 24 months.

2.7 Limitation of Liability. NovaStackCollective's total liability shall not exceed the total amount paid by the client for the specific project giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

2.8 Termination. Either party may terminate a project with 14 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date.

2.9 Governing Law. These Terms are governed by the laws of the Portuguese Republic. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Lisbon, Portugal.

Cookie Policy

3.1 What Are Cookies. Cookies are small text files stored on your device when you visit our website. They help us recognize your device and remember certain information about your visit.

3.2 Essential Cookies. We use strictly necessary cookies for: session management, security tokens, load balancing, and remembering your cookie consent preference. These cookies are required for the website to function and cannot be disabled.

Refund Policy

4.1 Deposit Refund. The initial deposit (50% of project value) is refundable within 7 days of payment if work has not yet commenced. After work has begun, the deposit becomes non-refundable.

4.2 Completed Work. Payment for completed and delivered work is non-refundable. Deliverables that materially deviate from the approved project proposal may be revised at no additional cost within 30 days of delivery.

4.3 Subscription Services. Monthly retainer and maintenance services may be cancelled with 30 days written notice. No refund is issued for the current billing period. Pre-paid annual subscriptions are refundable on a pro-rata basis minus a 10% administrative fee.

4.4 Dispute Resolution. Refund requests should be submitted in writing to [email protected]. We will respond within 5 business days. Unresolved disputes may be referred to the Centro de Arbitragem de Lisboa (Lisbon Arbitration Center).
